"Cormon Wins Again In Corrocean Patent Case
The Norwegian Supreme Court has rejected an application by Norsk Hydro ASA and Corrocean ASA for leave to appeal against this summer's Appeal Court verdict which acquitted Cormon of patent infringement.
The verdict, which also invalidated Claim 1 of the Norwegian Patent that
formed the basis of the action, brings to an end the available legal process
within Norway. Norsk Hydro ASA and Corrocean ASA will now be liable to pay
costs to Cormon for both previous hearings and the Supreme Court application.
The case centered on claims by Hydro and Corrocean that Cormon had infringed
their sand quantification patent, key aspects of which Cormon has always
maintained to be invalid in light of the prior art. The verdict confirms
the opinion of the European Patent Office and the UK Patent Office that
the use of Electrical Resistance techniques to measure erosion was not novel
at the time of the Norwegian filing.
